The sole reason we have the fair trial clause in the Constitution is because of people like Tsarnaev. John Adams gave British soldiers who had committed war crimes a fair trial, why treat Dzhokar any different?
We're no better than our enemies should we use the NDAA to indefinitely detain and/or execute him.
If Tasrnaev doesn't get a fair trial, this will have all been for nothing.
